Patents

A patent is a legal monopoly giving the owner the right to stop third parties from making, selling, importing or otherwise using an invention without permission.

A patentable invention must be new and have an inventive step at the time of filing a patent application. This means that the principle or idea of the invention must not have been disclosed to the public even by the inventor.

If these conditions are met, and you want to stop others from unauthorised use of your idea, it would be worth considering a patent application.

We will work with you to determine what you need to protect and the best way to do it.

Trademarks

Filing an initial application for a Trade Mark Registration at the UK Patent Office is a relatively simple process. It is not so easy however to decide:

• In what form the Trade Mark should be presented;

• How the goods or services should be described;

• Whether the chances of success justify the non-refundable fee; and

• Whether there are third party rights which might threaten you.

We work with you to consider these points and, if appropriate, we will then file an application at the Trade Marks Registry.

Registered Designs

A registered design protects the outward appearance of an article. It does not protect any underlying principle or idea.

It may protect either the shape of the article or a pattern applied to the article, provided these features appeal to and are judged by the eye.

The registration of a design for gives you the sole right in the UK and the Isle of Man to make, sell, import for sale, hire or use in business such articles incorporating the Design (or a Design not substantially different). Consequently, you may take legal action against an infringer and claim damages.

A design registration does not protect features dictated solely by the function of the article.

A design registration does not protect features which are dependant on the appearance of another article of which the proposed design forms an integral part.

For the registration to be valid, the Design must be new and the article to which the design is applied must be of a type for which aesthetic considerations would normally influence a purchaser of the article.

What our Client’s Say about Us

"Adam Tolfree and the team at TPT Cambridge have been our trusted IP lawyers for several years, and their expertise has been invaluable to our company. Their professionalism and deep understanding of IP law have consistently impressed us. What sets them apart is their ability to not only grasp complex technical concepts but also suggest novel implementations for our patents and trademarks. Their support in filing applications and skillfully negotiating with relevant IP authorities has been instrumental in strengthening and expanding our IP portfolio."

“Several years ago I moved all of my company’s existing and new trademark and patent work over to Adam at Cambridge Patents. I did so because of the clarity of communication and explanations on complex topics from Adam. He helped me to understand the processes involved and was also extremely helpful in the patent writing stage – providing a very valuable sounding board for the areas of the invention that were novel and therefore of most importance to the patent. I would highly recommend his services – especially if you currently find the patent and trademark processes lacks clarity or you don’t feel you’re getting what you want from your current patent and trademark attorney.”

 “We have worked with Adam for many years. He has assisted us on both registration and defence of patents and trademarks. In one instance we had a trademark challenge from a large international company, and Adam negotiated a favourable co-existence agreement for us.

 We have found Adam to combine professionalism with a friendly and down-to-earth approach, and wouldn’t hesitate to recommend his services.”‘ Managing Director of a UK Manufacturer’

"I have known Roger and now Adam Tolfree for about 20 years.  Their firm first introduced me to the process of filing a patent.  The key message to any interested reader is that it’s not complicated.  There are many patent agents that specialise it making the process complicated.  I’ve met some of them!  Moreover, patents are not just for corporate.  TPT allows SME companies like mine to apply for patent protection where previously we felt it was unreachable.

I would recommend TPT because they are cost effective, transparent and clear in their drafting and explanations.  I have never found any reason to question their guidance"

“For over 30 years I have filed tens of patents with 4 international companies 5 attorney's and one spin out startup.

 He is by far the best patents attorney I have worked with. He quickly understands new concepts and writes succinct, clear, exhaustive filings. He offers well informed understandable advice as to the complexes of international patents. He does the best he can for client's ideas. For those are familiar patents, will know what I mean by that.

He makes the process as enjoyable as possible for someone who dyslexic and hates writing like myself.”

“As inventor I have been working with Adam since 2014 on innovative concepts and the submission of patent applications. Adam is an exceptional creative patent attorney who not only extracts the essence of the invention from you, but also quickly and comprehensively understands the subject matter, making the idea remarkably easy and understandable to anybody. The quality of his questioning skills and his ability to get inventive ideas from me was impeccable.”

“Adam has so far guided me through an unfamiliar and complicated process without any problems and ultimately it looks as if we should get the patent granted, which is great news. I would be happy to recommend TPT to anyone looking to undertake IP work.”

We've had a fantastic experience working with Adam Tolfree and his team. They have been proactive, always keeping us updated and advising on our trademarks with great clarity and advice on each step. Their fast replies and approachable, friendly manner make them a pleasure to deal with, and they’re always happy to answer any questions we have had, giving us helpful recommendations.

We feel fully supported and confident in their expertise that we have trusted them for many years now working together on multiple trademarks. Highly recommended!
